If you are using TCA's Services on behalf of a third party, such as a business or another entity, you represent and warrant that you have the legal authority to bind such an entity to these terms. By accepting these terms on behalf of a third party, you confirm that the entity agrees to be fully bound by these terms.

1.3 Agreement Acceptance

If you lack the aforementioned authority, or if you disagree with any part of these terms and conditions, you must not accept this agreement and are consequently prohibited from accessing and utilizing TCA's Services.

1.4 Acknowledgement and Acceptance

By accessing and utilizing TCA’s Services, you affirm that you have thoroughly read, comprehended, and consent to be legally bound by these terms. This Agreement, despite being in electronic form and not bearing your physical signature, constitutes a legally binding contract between you and TCA, governing your use of the Services.

1.5 Amendments and Revisions

TCA reserves the right to amend or modify

this Agreement or its policies related to the Services at our sole discretion and at any time. Such changes will be effective immediately upon posting the updated Agreement on our website, with the revision date noted. While TCA may endeavor to provide you with other forms of notice, such as email or notifications through the Services, it is your responsibility to periodically review this Agreement for changes. Your continued use of the Services following any amendments signifies your acceptance of those changes.

1.6 Immediate Effectiveness of Changes

Any revisions or updates to this Agreement will be effective immediately upon their posting on TCA's website, unless a different effective date is specifically noted. The introduction of new features, tools, services, or products by TCA is also subject to these Terms of Service. We will continuously strive to innovate and improve our offerings, and such advancements will adhere to and be governed by the framework of this Agreement.

2. Services & Access to Services

2.1 Service Provision and Limitations

Trading Card Association Limited ("TCA") retains the right, though not the obligation, to limit or restrict the sale or provision of our products and services to any individual, region, or jurisdiction. Such decisions will be made based on TCA's discretion and judgment, for reasons deemed necessary by us, without any requirement to disclose these reasons.

2.2 Product Descriptions and Pricing

TCA reserves the right to modify descriptions and pricing of our products at any time, without prior notice, at our sole discretion. We strive to provide accurate and up-to-date information, but cannot guarantee the absence of errors or outdated data.

2.3 Modifications to Products and Services

We maintain the authority to modify, adjust, or cease any of our products or services and the methods of their delivery or access. These changes can be made at any time, without prior notification to our users.

2.4 Right to Refuse Service

TCA reserves the right to refuse any order or service request placed by you. This decision may be based on various factors determined at our discretion.

2.5 Order Limitations and Cancellations

At our discretion, we may limit or cancel quantities purchased per individual, per household, or per order. This includes, but is not limited to, orders associated with the same customer account, the same payment method, and/or the same billing or shipping address. In the event an order is altered or cancelled, TCA will attempt to notify you using the contact information provided at the time the order was placed.

2.6 Legal Compliance and Offer Validity

Any offer for products or services on our site is null and void where prohibited by law. We comply with all applicable laws and regulations governing our operations and the sale of our products and services.

3. Prohibited Uses

3.1 Restrictions on Use

In the context of this Agreement, certain activities and behaviors are strictly prohibited when utilizing the Services or any Content provided by Trading Card Association Limited ("TCA"). These prohibitions are in place to ensure a safe, lawful, and respectful environment for all users. The following actions are prohibited:

(a) Engaging in any unlawful activities or purposes;

(b) Soliciting or encouraging others to partake in any illegal activities;

(d) Infringing upon or violating the intellectual property rights of TCA or any third party;

(e) Harassing, abusing, insulting, harming, defaming, slandering, disparaging, intimidating, or discriminating against individuals based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability;

(f) Providing or submitting false, inaccurate, or misleading information;

(g) Uploading, transmitting, or distributing viruses or any other types of malicious code that may harm or affect the functionality of the Services, third-party products and services, or the Internet;

(h) Engaging in spamming, phishing, pretexting, spidering, crawling, or scraping;

(i) Using the Services for obscene, offensive, or immoral purposes;

(j) Interfering with, circumventing, or compromising the security features of the Services, third-party products and services, or the Internet.

3.2 Enforcement and Termination

TCA reserves the right to terminate or restrict your access to the Services if you engage in any of the aforementioned prohibited activities. Such actions will be taken to maintain the integrity, security, and functionality of our Services and to protect the rights and safety of all users. Enforcement of these rules is at TCA's discretion, and any decision to terminate or restrict access is final.

4. Accounts and Membership

4.1 Account Security and Responsibility

When you establish an account with Trading Card Association Limited ("TCA"), you are solely responsible for safeguarding your account's security. You accept full responsibility for all activities conducted through your account and any actions taken in relation to it.

4.2 Confidentiality of Login Details

You agree to maintain the confidentiality of your login credentials and not to disclose them to any third party. It is your responsibility to prevent unauthorized access to your account.

4.3 Accuracy of Account Information

You commit to providing accurate, complete, and up-to-date information during the registration process and to promptly update your account information in case of any changes. This ensures that we can provide you with continuous and effective service.

4.4 Adherence to Privacy Policy

5. Advertisements

5.1 Interaction with Advertisements and Promotions

5.1.1 During your interaction with the Services provided by Trading Card Association Limited ("TCA"), you might engage with advertisements or participate in promotional activities hosted by third-party advertisers or sponsors. These interactions might involve viewing or purchasing goods and services advertised or promoted on TCA's platform.

5.1.2 Any form of engagement, correspondence, transaction, or participation in such advertisements or promotions, including the acceptance of any terms, conditions, warranties, or representations related to these activities, is exclusively a matter between you and the respective third-party entity. TCA acts merely as a facilitator for such advertisements and promotions and does not play any part in the actual transaction or agreement.

5.1.3 TCA holds no liability, obligation, or responsibility for any aspect of your interactions with third-party advertisers or sponsors. This includes, but is not limited to, the nature and quality of goods or services offered, the accuracy of the information provided, and the fulfillment of any terms, conditions, warranties, or representations made by the third party.

5.1.4 Users of TCA's Services are advised to exercise caution and due diligence before entering into any transactions or accepting any terms offered by third-party advertisers or sponsors. TCA recommends that users thoroughly review and understand all terms and conditions associated with such third-party engagements.

6. Suspension and Termination

6.1 Account Cancellation by User

6.1.1 As a user of Trading Card Association Limited ("TCA"), you have the right to cancel your account at any time. To initiate the cancellation process, please send a request to tcacardinfo@gmail.com

6.1.2 Upon cancellation, you may also request the removal of your personal data that is stored in our systems. TCA will comply with this request in accordance with applicable data protection laws. However, please note that this does not include data related to past transactions, invoices, services rendered, or other operational data that does not contain personally identifying information. Such data is retained to maintain records essential for the effective functioning and legal compliance of TCA's services.

6.2 Account Suspension or Termination by TCA

6.2.1 TCA reserves the right to suspend, disable, or terminate your account, or any part of it, if we determine that you have breached any terms of this Agreement. This action may also be taken if your conduct, actions, or content are deemed detrimental to TCA's reputation, integrity, or goodwill.

6.2.2 In the event of such termination due to a breach of the Agreement or damaging conduct:

You are prohibited from re-registering or accessing TCA's Services under a different account or identity.

Any attempts to circumvent this termination, such as creating a new account or using an alternative identity, are strictly prohibited.

TCA may take further preventive measures, including but not limited to blocking your email address and Internet Protocol (IP) address to prevent new registrations or access to our services.

7. Billing and Payments

7.1 Accurate Billing Information

7.1.1 As a user of Trading Card Association Limited ("TCA"), you are obligated to provide current, complete, and accurate information for all your purchases through our Services. This includes ensuring that your account information, including billing and payment details, is up-to-date and accurate at all times.

7.2 Data Security and Compliance

7.2.1 TCA is committed to protecting the privacy and security of your sensitive data. All transactions and data exchanges on our platform are conducted over SSL (Secure Socket Layer) secured communication channels. This technology encrypts and protects your data with digital signatures, ensuring a high level of security.

7.2.2 Our Services comply with the Payment Card Industry Data Security Standard (PCI DSS) to ensure a secure environment for our users. We regularly perform malware scans and implement other security measures to maintain the integrity and safety of our platform.

7.3 High-Risk Transactions

7.3.1 TCA reserves the right to take additional verification steps for transactions deemed as high-risk. In such cases, you may be required to provide further documentation for verification purposes. This may include:

A copy of a valid government-issued photo identification (such as a passport or driver's license).

A recent bank statement for the credit or debit card used in the transaction.

7.3.2 These additional verification measures are implemented to enhance transaction security and prevent fraudulent activities. Your cooperation in providing the necessary documentation promptly is appreciated.

8. Shipping and Freight Services

8.1 Shipping Process and Responsibility

8.1.1 Trading Card Association Limited ("TCA") strives to ship your orders promptly, but we do not guarantee specific shipping times. We recommend that customers sending card submissions to TCA use tracked and insured shipping options. TCA assumes responsibility for shipments only upon their receipt and confirmation by our staff at our designated premises.

8.2 Return Insurance Option

8.2.1 TCA offers return insurance for an additional fee, which is optional and must be selected by you during the checkout process. This insurance provides added protection for your items during transit back to you.

8.3 Risk without Return Insurance

8.3.1 In cases where return insurance is not selected, you acknowledge and agree that any loss or damage incurred after the order leaves TCA's premises is your sole responsibility. TCA is not liable for any such losses or damages.

8.4 Liability for Uninsured Shipments

8.4.1 Shipments sent without return insurance are sent at your risk, and TCA does not assume liability for any loss or damage incurred during standard or express post transit.

8.5 Basis of Insurance and Liability Claims

8.5.1 Insurance claims and liabilities are based on the declared value of the card that you have provided during the submission process. This valuation is irrespective of the card's current market or replacement value.

8.6 Limitations of Insurance Coverage

8.6.1 The return insurance does not cover damage arising from events not attributable to the chosen postal or courier service, such as natural disasters (e.g., flooding, fires).

9. Third-Party Services

9.1 Use of Third-Party Services

9.1.1 If you choose to enable, access, or use third-party services, be aware that such use is governed by the terms and conditions of the respective third-party services. TCA does not endorse, is not responsible for, and makes no representations about any aspect of these third-party services, including their content, data handling, or user interactions.

9.2 Waiver of Claims

9.2.1 By using third-party services, you irrevocably waive any claim against TCA concerning such services.

9.3 Limitation of Liability

9.3.1 TCA is not liable for any harm, loss, or damage arising from your use of third-party services, nor for your reliance on their privacy practices or security processes.

9.4 Data Disclosure to Third-Party Services

9.4.1 Should you engage with third-party services, you may need to register or log into these services on their platforms. By enabling such services, you consent to TCA disclosing your necessary data to facilitate or enable the use of these third-party services.

10.1.1 While Trading Card Association Limited ("TCA")'s Services may provide links to other external resources (like websites and mobile applications), such linking does not imply our endorsement, approval, association, sponsorship, or affiliation with those resources, unless explicitly stated.

10.2 No Endorsement of External Content

10.2.1 TCA does not review, evaluate, or warrant the offerings of any external businesses, individuals, or the content on their resources. The responsibility to verify the quality and authenticity of these external offerings rests with you.

10.3 No Liability for Third-Party Actions

10.3.1 TCA bears no responsibility or liability for the actions, products, services, or content of any third parties linked through our Services. We advise users to carefully review legal statements and usage terms of any external resources accessed through our links.

10.4 Risk in Accessing External Resources

10.4.1 Accessing off-site resources through links provided by TCA is done at your own risk.

11. Intellectual Property Rights

11.1.1 The Agreement does not transfer any intellectual property rights in TCA's Services or third-party services to you. All rights, titles, and interests in such intellectual property will remain exclusively with TCA or the respective third-party owners.

11.2.1 All trademarks, service marks, graphics, and logos used in connection with TCA's Services are trademarks or registered trademarks of TCA or our licensors. Trademarks of third parties are the property of their respective owners.

11.3 No License Granted

11.3.1 Your use of TCA's Services does not grant you any right or license to reproduce or otherwise use any TCA or third-party trademarks.

11.4 User Submissions

11.4.1 If you send us specific submissions (like contest entries) or unsolicited creative ideas, suggestions, proposals, plans, or materials, you agree that TCA may, at any time, without restriction, use these in any way we see fit.

11.4.2 TCA is not obligated to:

Keep any submissions confidential;

Compensate you for any submissions;

Respond to any submissions.

12. Disclaimer of Warranty

12.1 “As Is” Basis

12.1.1 TCA provides Services on an “as is” and “as available” basis. Your use of the Services is solely at your own risk.

12.2 No Warranties

12.2.1 TCA expressly disclaims all warranties, express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

12.3 No Guarantee of Service

12.3.1 We do not warrant that the Services will meet your specific requirements, or that the Services will be uninterrupted, timely, secure, or error-free. We also do not guarantee the accuracy, reliability, or quality of any information obtained through the Services.

12.4 User Risk

12.4.1 Any material downloaded or otherwise obtained through the use of our Services is done at your own discretion and risk. You are solely responsible for any damage to your computer system or loss of data resulting from such downloads.

12.5 No Warranty on Third-Party Transactions

12.5.1 TCA makes no warranty regarding any goods or services purchased or obtained through the Services, or any transactions entered into through the Services, unless explicitly stated by TCA.

12.6 No Advisory Warranties

13. Limitation of Liability

13.1 Scope of Liability

13.1.1 To the fullest extent permitted by law, Trading Card Association Limited ("TCA") shall not be liable for any indirect, incidental, special, punitive, consequential damages, or any other similar damages under any liability theory, including, but not limited to, lost profits, revenue, sales, goodwill, content use, impact on business, business interruption, or loss of business opportunities, regardless of the cause and whether arising in contract, tort (including negligence), breach of statutory duty, or otherwise. This applies even if TCA has been advised of the possibility of such damages or if such damages could have been reasonably foreseen.

13.2 Limitation on Aggregate Liability

13.2.1 The total aggregate liability of TCA related to the Services will not exceed the greater of one dollar or the total amount paid by you to TCA for the services in the one-month period preceding the first event giving rise to such liability. This limitation applies regardless of whether this remedy fully compensates you for any losses or fails its essential purpose.

14. Indemnification

14.1 Responsibility for Actions and Content

14.1.1 You agree to indemnify and hold harmless Trading Card Association Limited ("TCA") from any liabilities, losses, damages, or costs, including reasonable attorneys’ fees, that arise from or relate to any third-party allegations, claims, actions, disputes, or demands. This indemnification is specifically in connection with your content, your use of the Services, or any willful misconduct on your part.

15. Severability

15.1 Enforceability of Provisions

15.1.1 The rights and restrictions contained in this Agreement are applicable and binding only to the extent that they do not violate any applicable laws. These terms are intended to be limited to the extent necessary to prevent this Agreement from being illegal, invalid, or unenforceable.

15.2 Validity of Remaining Provisions

15.2.1 If any provision, or portion of a provision, in this Agreement is held to be illegal, invalid, or unenforceable by a court of competent jurisdiction, the intention is that the remaining provisions or parts thereof shall constitute the agreement regarding the subject matter herein. All remaining provisions or parts thereof shall remain in full force and effect.

16. Dispute Resolution

16.1 Governing Law

The formation, interpretation, and performance of this Agreement, and any disputes arising from it, shall be governed by the substantive and procedural laws of Australia. This includes disregarding any conflict of law provisions and applying the laws of Australia to the extent they are applicable.

16.2 Jurisdiction

Any legal actions or proceedings related to this Agreement shall exclusively be brought in the courts located in Australia. By using our Services, you consent to the jurisdiction of these courts for any such disputes.

16.3 Waiver of Jury Trial

You hereby waive any right to a jury trial in any legal proceedings arising out of or related to this Agreement.

16.4 International Sale of Goods ExclusionThe United Nations Convention on Contracts for the International Sale of Goods does not apply to this Agreement.

17. Assignment

17.1 Restrictions on Assignment

You are not permitted to assign, resell, sublicense, or otherwise transfer any of your rights or obligations under this Agreement, in whole or in part, without the prior written consent of Trading Card Association Limited ("TCA"). Any attempt to do so without such consent will be null and void.

17.2 TCA’s Right to Assign

TCA reserves the right to freely assign any of its rights or obligations under this Agreement, in whole or in part, to any third party as part of a business transaction, such as the sale of assets or

a merger.

18. Miscellaneous

18.1 Headings for Convenience

The headings in this Agreement are included for convenience only and will not limit or otherwise affect the interpretation of these Terms.

18.2 No Quality Warranty

TCA does not guarantee that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected, unless explicitly required by law.

18.3 Correction of Errors

Information on TCA's Services may occasionally contain typographical errors, inaccuracies, or omissions related to product availability, promotions, and offers. TCA reserves the right to correct any errors, inaccuracies, or omissions, and to change or update information or cancel orders if any information in the Services is inaccurate at any time without prior notice.

18.4 Color and Image Accuracy

While TCA endeavors to accurately display product colors and images, we cannot guarantee that your computer monitor's display will be accurate.

19. Acceptance of these Terms

19.1 Agreement Acknowledgment and Consent

19.1.1 By accessing and using the Services of Trading Card Association Limited ("TCA"), you acknowledge that you have thoroughly read and understood this Agreement. You agree to be legally bound by all its terms and conditions. Should you disagree with any part of this Agreement, you are expressly prohibited from accessing or using TCA's Services.

19.2 Non-waiver of Rights

19.2.1 TCA's failure to exercise or enforce any right or provision outlined in these Terms of Service does not constitute a waiver of such right or provision. Our rights under this Agreement remain valid and enforceable.

19.3 Entire Agreement

19.3.1 These Terms of Service, along with any policies or operating rules published by TCA on our website or in relation to the Service, represent the complete and exclusive agreement between you and TCA. They supersede all prior or contemporaneous agreements, communications, and proposals, whether oral or written, between you and TCA (including, but not limited to, any earlier versions of the Terms of Service).

19.4.1 In the event of any ambiguities or uncertainties in the interpretation of these Terms of Service, such ambiguities shall not be construed against TCA as the drafting party. The interpretation of these terms shall aim to reflect the mutual intent of both parties equitably.

20.1.1 "Agreement" refers to these Terms and Conditions as outlined in this document, including any future modifications, revisions, or amendments.

20.3.1 "Mobile Application" refers to the official mobile application provided by TCA for accessing its services.

20.4.1 "Services" is a broad term that encompasses, but is not limited to, the usage and engagement with TCA's website, mobile application, and any related products and services offered by Trading Card Association Limited.

20.5 User

20.5.1 "You," "User," and "Your" are terms used to describe any individual, group of individuals, business, organization, or entity that accesses, engages with, or attempts to engage or access the services of Trading Card Association Limited.

20.6 TCA

20.6.1 "TCA," "We," "Us," and "Our" refer to Trading Card Association Limited, encompassing its successors, assigns, related companies, officers, directors, employees, agents, affiliates, suppliers, and licensors.

20.7 Intellectual Property Rights

20.7.1 "Intellectual Property" and "Intellectual Property Rights" include all current and future rights granted by statute, common law, or equity. This encompasses rights related to copyright, trademarks, designs, patents, inventions, goodwill, and the right to sue for passing off. It also covers rights to inventions, use rights, and all other intellectual property rights, whether registered or unregistered. This includes all applications, rights to apply for, and be granted rights, claim priority, and all similar or equivalent rights or forms of protection that exist or will exist in the future, anywhere in the world.

20.8 Comments

20.8.1 "Comments" collectively refer to any submissions made or sent to us by you, whether solicited or unsolicited. This includes creative ideas, suggestions, proposals, plans, or other materials, shared through any medium, including online, email, postal mail, or otherwise.

21. Abandoned Orders

21.1 Understanding Circumstances

21.1.1 Trading Card Association Limited ("TCA") recognizes that there may be situations preventing customers from collecting their orders within a reasonable timeframe. However, TCA cannot indefinitely hold onto unclaimed orders.

21.2 Definition of Abandoned Orders

21.2.1 Orders that remain uncollected by a customer for one year from the order date will be considered "abandoned." TCA will undertake reasonable efforts to remind the customer of their outstanding order by phone and email. However, if TCA is unable to reach the customer, or if the customer does not collect the order within this timeframe, the order will be deemed abandoned.

21.3 Disposal of Abandoned Orders

21.3.1 In instances of abandoned orders, TCA reserves the right to dispose of the items as deemed appropriate. This may include, but is not limited to, donating the items to charitable or not-for-profit organizations.

21.4 Communication and Postponement Requests

21.4.1 TCA understands unforeseen circumstances may prevent timely order collection. Customers are encouraged to communicate with TCA if they foresee delays in picking up their orders. Should a customer need to postpone their collection or request shipping of their order, they are advised to contact TCA at least 48 hours in advance to arrange alternative solutions.
